勞工職業災害保險及保護法

為增進遭遇職業傷病被保險人醫療給付權益，自111年5月1日「勞工職業災害保險及保護法」施行後，被保險人因職業傷病及其引起的疾病就醫，經全民健保特約醫院或診所醫師認定有醫療上需要，選用全民健康保險法規定的自付差額特殊材料品項者，可先墊付自付差額後，再向勞保局申請核退差額費用。

With Effect from May 1, 2022, Workers Covered by Occupational Accident Insurance May Claim Reimbursement of the Partial Out-of-Pocket Payment against the Difference of Special Material.

If due to injury/sickness caused by occupational reasons, the insured person is identified as having medical needs by the physicians in the NHI hospitals or clinics and such insured person selects special materials and items specified in the National Health Insurance Act, he/she may, after settled the partial out-of-pocket payment, apply to the BLI for the reimbursement of such payment. This took effect on May 1, 2022, the implementation date of the Labor Occupational Accident Insurance and Protection Act. It will provide further protection to the rights and interests of the workers suffering from occupational injury/sickness.
