請領育嬰留職停薪津貼期間，可以在其他公司擔任負責人嗎？

❌不可以❌

被保險人於育嬰留職停薪期間，如有依公司法或商業登記法等規定擔任他單位法定負責人（包括董事、監察人、合夥人、經理人等），會推定有從事事業經營，不能請領育嬰留職停薪津貼喔！

🟡但被保險人如符合下列其中之情形，得檢具相關證明文件，本局仍得依法核發育嬰留職停薪津貼。

1️⃣ 該單位屬非營利事業之證明文件。

2️⃣ 申請人已無從事事業經營者：

✅該單位已依法停(歇)業或解散之證明文件。

✅該單位已依法變更負責人，應檢附向目的事業之主管機關或財稅主管機關變更登記之證明文件。

✅該單位出具與申請人解除或終止董事或監察人等委任關係之證明文件。

✅申請人遭該單位冒名登記為負責人，但無法提供上開證明者，應檢附向檢察機關提出告訴之證明文件。

Can I act as a person-in-charge of another company during the period in which I’m receiving subsidy for maternal leave without pay?

❌No❌

If the insured person is the legal representative (including board member, ombudsman, partner, executive, etc.) of another organization as stated by the Company Act or Business Registration Act during the period of maternal leave without pay, it is inferred that they engage in business operations and may not claim subsidy for maternal leave without pay!

🟡However, if the insured person meets any of the following requirements and may submit document evidence as proof, this bureau must issue subsidy for maternal leave without pay in accordance with the law.

1️⃣ Documents proving that the organization is a non-profit business.

2️⃣ The applicant is no longer engaged in business operations:

✅Documents proving that the organization has suspended (ceased) business or is dissolved in accordance with the law.

✅If by law, the person-in-charge of the organization has changed. Documents proving a change of registration from the competent authority or tax authority must be provided.

✅ If the organization can provide documentation that the applicant’s role as a board member or ombudsman has been cancelled or terminated.

✅ If the applicant has been falsely registered as a person-in-charge but is unable to submit any evidence listed above, they must submit documentation of litigation from the procuratorate.
